This is the beginning of the end of the USA as we know it.
We as a country are far too divided to continue with the current situation as a country. We are now seeing states do what they should have done long ago, exercise their power under the US Constitution. Few realize just how much power was given to states vs federal government.
“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
Amendment X US Constitution
So the Constitution delgated powers to the Federal government and those not delegated are reserved for the states and the people.
Congressional Powers
Article 1 Section 8 lists all the powers Congress was delegated. If that power is not listed Congress was not delegated that power.
What are Delegated Powers
Presidential Powers
Article 2 Section 3 lists the powers of the President.
Power to make treaties, however that is not a lone power. The President must have the advice and consent of the Senate.
Power to appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court. Again he must have consent of the Senate.
Power to fill vacancies when Congress is not in session. The appointees terms expires at the end of Congresses next session.
Power to adjourn Congress. This power has never been used, but it is available when Congress becomes deadlocked. This clause however does not give the President carte’ blanc to make law, ignore law etcetera.
Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.
Well that’s all the Presidential powers listed. I’m not seeing one on student loans, forced vaccination, interpeting the Bill of Rights, or much of anything else pertaining to the citizens of the US. Again powers not granted are powers that do not exist except in feeble minds or those hungery for power.
The President is given duties, duties as we all know are not power. He has the duty to meet foreign dignitaries, enforce and faithfully execute the laws of the US, give an update on the state of the Union.
So the Presient is actually the 2nd weakest branch of government.
Supreme Court Powers
Art. III, Section 2 lists the Supreme Courts power
restricts the judiciary's power to actual cases and controversies
The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;—to all Cases affecting Ambassadors, other public Ministers and Consuls;—to all Cases of admiralty and maritime Jurisdiction;—to Controversies to which the United States shall be a Party;—to Controversies between two or more States;—between a State and Citizens of another State;—between Citizens of different States;—between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.
The Supreme Court is the only court establsihed in the Consitution, all other courts are established by Congress. The number of members of the Supreme Court are established by Congress, the court nor the President have any power to change this.
So what is the enforcement mechanism, what agency was established to enforce these powers? NONE! The founders were very weary of a national police force therefore they established none. In all the powers listed above did they grant the power to establish a national police force? No they did not. Their was no need as the powers granted are very specific and very few.
All these agencies, powers used and not listed are phatoms, delusions of grandeur, illegal under the powers granted by the Constitution.
Delusional disorder is a serious mental illness where you can’t tell the difference between what’s real and what’s not. Delusions, or false beliefs, comes in several types. Delusions of grandeur are one of the more common ones. It’s when you believe that you have more power, wealth, smarts, or other grand traits than is true.
Seems we have a problem Houston, we have a large city out east that is full of these delusional people. They are trying to run our lives, ordering us around when then have not been granted such power.
So the Supreme Court is actually the weakest, they have ZERO power to raise and army, fund an army - words is all they have and Congress controls how many Supreme Court members their are so their could be fewer members throwing their legal weighty words around.
High noon at the Texas border
I realize this is getting some what out in the weeds but a base must be establsihed from which to look at what is happening today - specifically witht he current crisis at the border.
We now have a Constitutional crisis that has been brewing for a long time, as the states have let themselves be pushed around by delusional people. This was bound to happen, you can only push so far before a breaking point is reached.
One of the duties of a President is to enforce the laws of the USA. Nowhere does the Constitution say as he chooses or the ones or parts of one he chooses
Article I, Section 8, Clause 18:
So Congress makes the laws and the President is relegated to carrying those laws out. Congress has not delegated any immigration law making ability to the President. His duty is to enforce/implement what Congress has passed.
Clause 3 Acts Requiring Consent of Congress
No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.
Article 1 Section 10 Clause 3
Texas has declared - and properly so an invasion is taking place. We have had a mass of people actively engaged in illegal border crossing. This has gone on for decades and is now reaching a breaking point. Thus, we now have states forming compacts to stop the invasion. All perfectly Consitutional under Article1 Section 10 Clause 3 .
As we can clearly see States are allowed to protect themselves from invasion.
The Supreme Court , not to be left out has now stepped in with their .02.
We now hear the chatter class and others saying Abbott is ignoring the Supreme Court - he is not as the court said NOTHING to Texas, they merely said the feds can remove the wire, nothing saying the state cannot put it back up or take any down. The only force the feds have is military force and using them is going to expose a horrific underbelly of just how weak the feds are and how desperate they are to hold onto power they took and were never granted. Its going to pit military units state and federal against each other further dividing us. When we reading leagl opions we must read what they said and understand what they said. Abbott and the states are doing just that.
( I’ll have another stack on the history of Supreme Court rulings that were properly ignored. )
Governor Abbott Issues Statement On Texas’ Constitutional Right To Self-Defense
January 24, 2024 | Austin, Texas | Press Release
Governor Greg Abbott today issued a statement on Texas’ constitutional right to defend and protect itself as President Joe Biden continues to attack Texas and refuse to perform his duties to secure the border.
"The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now," reads the statement. "President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary."

The federal government has broken the compact between the United States and the States. The Executive
Branch of the United States has a constitutional duty to enforce federal laws protecting States, including
immigration laws on the books right now. President Biden has refused to enforce those laws and has even
violated them. The result is that he has smashed records for illegal immigration.
Despite having been put on notice in a series of letters—one of which I delivered to him by hand—President
Biden has ignored Texas’s demand that he perform his constitutional duties.
• President Biden has violated his oath to faithfully execute immigration laws enacted by Congress.
Instead of prosecuting immigrants for the federal crime of illegal entry, President Biden has sent his
lawyers into federal courts to sue Texas for taking action to secure the border.
• President Biden has instructed his agencies to ignore federal statutes that mandate the detention of
illegal immigrants. The effect is to illegally allow their en masse parole into the United States.
• By wasting taxpayer dollars to tear open Texas’s border security infrastructure, President Biden has
enticed illegal immigrants away from the 28 legal entry points along this State’s southern border—
bridges where nobody drowns—and into the dangerous waters of the Rio Grande.
Under President Biden’s lawless border policies, more than 6 million illegal immigrants have crossed our
southern border in just 3 years. That is more than the population of 33 different States in this country. This
illegal refusal to protect the States has inflicted unprecedented harm on the People all across the United
States.
James Madison, Alexander Hamilton, and the other visionaries who wrote the U.S. Constitution foresaw that
States should not be left to the mercy of a lawless president who does nothing to stop external threats like
cartels smuggling millions of illegal immigrants across the border. That is why the Framers included both
Article IV, § 4, which promises that the federal government “shall protect each [State] against invasion,” and
Article I, § 10, Clause 3, which acknowledges “the States’ sovereign interest in protecting their borders.”
Arizona v. United States , 567 U.S. 387, 419 (2012) (Scalia, J., dissenting).
The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I,
§ 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already
declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and
protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the
contrary. The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are
acting on that authority, as well as state law, to secure the Texas border.
Greg Abbott
Governor of Texas
How will this all turn out? In this instance someone is going to blink. If its the states then their will be another crisis and eventual split. The only hope and its a extremely small hope - to keep the USA together is for the states to win and exercise their power under the Consitution. Even this will change the landscape where states are even more strident and independent, but the union coud survive. If the feds win the die will be cast for balkanization as they will continue their iron fist rule and become even more bleigerant and sooner or later someone is going to say enough.
All this has been simmering for decades, the delusional people we elect to federal offices have been pushing and pushing and now we are at the point everything will be a point of contention. Its like a couple that has been simmering over various issues for decades and now merely being in each others presence turns into a fight. These delusional people in federal offices have no real world basis. They go there, and stay. Even when we kick them out of office they stay in DC getting a job as a lobbyist not wanting to go back home and rub elbows with the lessers - ie us.
We are now at the point the USA will balkanize into 6 or 7 regions. The coasts, inter mountain west, great plains, midwest- separated by the Missouri River, mason dixon line. Each of these regions has become entities unto themselves. We see this on a micro level in some states, Nebraska the eastern 2/3rds vs the panhande, Parts of Oregon are now wanting split off and join Idaho. Recently a federal judge threw out a petion on Texas seceding from the union. The ruling class no longer respects the citizenry, they have been pushing the citizens around for decades, slowly, insidiously but now its full on in your face.
Different culture and beliefs. By 2032 the USA will be a remnant of history. We are now seeing the elitists of the coasts willing to burn the country to the ground for their political agenda and beliefs and now the interior people are starting to stand up.
The social compact is now broken and the fissures will become more evident to all of us over the next 12-24 months. I can see a day where you will need a passport to travel through these different regions - yes the split is that deep.
If we thought the covid mask and jab cult was bad, chasing people down and badgering them demanding that un jabbed be segregated and locked up, had the media nd entertainment industry demanding those not jabbed or masked be locked up, whats about to happen will pale that. That was a walk in the park on a bright Sunday afternoon compared to what is about to take place.
People have serious thinking to do and decisions to make. Where are you going to live your life out over the next 30 -40-+50 years? Seriously this life many of us boomers, xers etcetera have lived under is hanging by a shredded thread. The coasts have shown just how intolerant and elitist they are and it only gets worse from here. If you are a believer in small un intrusive government you’d better move to such a state soon as their will be no place for you in these statist authoritarian places. They will harrass you until you leave, or you submit to their ideology or just decide to live with people lording over you.
This reminds me and the Anne Frank story where her dad knew he should get out of Germany but did not as he had a life there he did not want to leave. We all know how that turned out. Its human nature, it takes great bravery to move on to a different place when you have a life that you have worked hard for. However if you plan on living anywhere close to a comfortable life you should consider do I want to stay here and fight or go to where like minded people live where I can be free to speak vs living where you literally fear for your life or are in such isolation it is mentally ruinous.
Make some popcorn, keep this post in mind as we go through the next 10 years. I hope I am wrong but the writing on the wall is as obvious as the nose on our faces.
The people have gotten lazy and complacent. We are busy living our best life! No time to worry about these things that don’t directly affect us (or so we tell ourselves) so we relinquish our power and do away with our critical thinking. And most people feel they have no power or sway, so why bother. Let those we elected (gave our power to) handle it. I would guess that most people really don’t know what the Constitution says. I certainly didn’t learn about the Constitution in school. Oh wait….I do remember something about we the People in order to form a more perfect union. People just listen to what some talking head or newsreader tells us the constitution says and take it as truth. And we are being told the President has the power, so it must be true. These people surely know what they are talking about…..and you know, we just don’t have time to bother researching. Just look at medicine. Certainly the Drs. know more than us. How many of us or Drs. for that fact do their own research? Most just take the easy route and assume that if someone in a position of authority says it, they certainly must know what they are talking about.
