Trump barred from Colorado ballot
So news broke this evening that Trump is to be banned from the Colorado ballot. This is purely political
#1 its a 213 page opinion. That alone tells you they have nothing. Legal opinions when the facts are on your side are short and sweet. Long opinions are stretching for legitimacy because the opinion is illegitimate
#2 They seem to be hanging their hat on the 14th section 3
Section 3 is as follow:.
No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.
Does anyone see where is mentions the President? Electors is electoral college. This maybe a weak argument but it is a legitimate question since it specifically bars House and Senate and does not specifically mention President.
#3 is the big one in my opinion. They seem to be hanging heavily on the alleged “insurrection”. Maybe I missed it but was he found guilty of fomenting insurrection? Was their even a trial? This court has shown it is illegitimate with this opinion. It is convicting him of a crime that was never even a charged crime.
This has HUGE implications for us and our legal system and rights. If Trump can be barred from running for office for literally nothing what can they do to us if we decide to use our 1st amendment rights. These people are destroying this country right in front of our eyes. I don’t care if you like Trump or hate him, we MUST look past our feelings for one man and look at the damage to our system of government. This is USSR stuff, this is something Putin would have his courts do.
It is past time to stop looking at these small issues of personalities and start looking big picture. In this case the big picture is pretty damn ugly.
We MUST take our system back and stop letting these despots lead us around be the nose. We can do this but we must be informed. This is a start. Our future, our children, our grand children are depending on US to leave them a free and functioning society not some despotic society run by tyrants.
